Terms of Use

These Terms govern access to the Aisimilate web app, its AI-assisted English learning features, account services, and related support operations.

These Terms apply when you create an account, sign in, or otherwise use Aisimilate. Read them together with the Privacy Policy and Cookie Policy. If a separately signed enterprise or institutional agreement expressly overrides these public terms, that signed agreement controls to the extent of the conflict.

1. Provider and contract formation

Aisimilate is operated by s4p OÜ (Reg: 17415128, VAT: EE102945199), registered at Harju maakond, Tallinn, Kesklinna linnaosa, Tornimäe tn 5, 10145. These Terms become binding when you create an account, sign in, or otherwise use the service.

2. Eligibility and account responsibility

You must have legal capacity to use the service, or valid parent, guardian, employer, school, or organization authorization where that is required by applicable law. You are responsible for keeping your account information accurate and for all activity carried out through your account.

You must keep your password and other credentials confidential and notify support@aisimilate.app promptly if you suspect unauthorized access. Aisimilate may invalidate sessions, require extra verification, or suspend access where reasonably necessary to protect the account or platform.

If you use Aisimilate on behalf of a company, school, or other organization, you represent that you have authority to bind that entity to these Terms, and references to "you" include both you and that entity where the context requires it.

3. Service scope

Aisimilate currently provides an AI-assisted English learning experience, including account registration, sign-in, adaptive lessons, vocabulary practice, learner progress reporting, profile settings, and related support or administrative functions.

We may add, remove, refine, or replace features over time. Preview or beta functionality may be less stable, may change without notice, and may be withdrawn if needed for quality, legal, or security reasons.

We may perform maintenance, emergency remediation, migration, security updates, or infrastructure changes that temporarily affect availability. We are not liable for delays or failures caused by events outside our reasonable control, including infrastructure outages, telecommunications failures, force majeure events, regulatory actions, or third-party platform disruptions.

4. Acceptable use

  • Use Aisimilate only for lawful purposes and with proper authority.
  • Do not attempt to bypass security controls, access restrictions, or rate limits.
  • Do not upload or submit content you are not authorized to use.
  • Do not use the service for malware, phishing, abuse, harassment, fraud, or deceptive impersonation.
  • Do not interfere with the service, its API, or other users' ability to access it.
  • Do not scrape, mass-export, reverse engineer, or use the service to build competing datasets, models, or automated extraction workflows in breach of law, these Terms, or technical restrictions.
  • Do not use the service in a way that would cause export-control, sanctions, or trade-compliance violations.
  • Do not use Aisimilate in a way that would violate applicable education, privacy, consumer, export-control, or AI rules.

5. AI-generated lessons and human review

Some Aisimilate features generate lessons, explanations, coaching, or other outputs with the help of AI systems. Those outputs are probabilistic and may contain mistakes, omissions, bias, or outdated phrasing. You remain responsible for reviewing and deciding how to use the results.

Aisimilate is designed as assistive learning software. It is not offered as a substitute for legal, medical, financial, employment, credit, safety-critical, or other high-impact professional judgment.

6. Your content and service rights

You retain rights in the content you submit, subject to the limited rights needed for Aisimilate and its processors to host, transmit, secure, back up, analyze, and process that content to deliver the service, prevent abuse, investigate defects, and comply with law.

You represent that you have a valid basis to submit the content you provide and that doing so does not infringe third-party rights or breach confidentiality obligations.

The Aisimilate service, software, interfaces, branding, documentation, and non-user-generated content are owned by or licensed to s4p OÜ and are protected by intellectual-property laws. Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable right to use the service for its intended purpose.

If you submit feedback, suggestions, improvement ideas, or feature requests, you grant s4p OÜ a worldwide, non-exclusive, irrevocable, perpetual, royalty-free right to use, adapt, publish, and implement that feedback without compensation or confidentiality obligation, unless a separate written agreement expressly says otherwise.

7. Business-use responsibility

For business, institutional, or other non-consumer use, you are responsible for internal authorization, user administration, lawful instructions to your personnel, and the legality of the data you choose to process through Aisimilate.

To the maximum extent permitted by law, a business or institutional user will defend and indemnify s4p OÜ against third-party claims, losses, and reasonable costs arising from that user's unlawful content, breach of these Terms, or misuse of the service. This sentence is not intended to reduce mandatory consumer rights.

8. Paid features if introduced

Aisimilate may later introduce paid plans, subscriptions, or one-time purchases. If that happens, pricing, plan scope, billing intervals, taxes, renewal terms, and any applicable refund or withdrawal information will be shown in the relevant checkout, order form, or account flow before you are charged.

Payments may be handled by third-party payment processors. Aisimilate may suspend fulfillment, block future orders, or retain reasonable evidence where payment fraud, chargeback abuse, failed verification, or sanctions-related risk is reasonably suspected.

Mandatory EU consumer rights apply where you qualify as a consumer under applicable law. For digital content or digital services that begin immediately at your express request, the right of withdrawal may be lost once performance begins, where that consequence is clearly disclosed before payment and permitted by law.

9. Suspension and termination

You may stop using Aisimilate at any time. We may suspend, restrict, or terminate access where reasonably necessary to protect the platform, investigate abuse, comply with law, address repeated misuse, respond to credible security risks, or prevent imminent harm.

Termination does not affect accrued rights, surviving legal obligations, retention duties, or claims that arose before access ended.

10. Warranties and liability

To the maximum extent permitted by applicable law, Aisimilate is provided on an as-available and as-configured basis. We do not guarantee uninterrupted availability, perfect accuracy, error-free output, or fitness for any regulated or mission-critical use case.

Unless a specific paid feature or written agreement says otherwise, Aisimilate is not a guaranteed archival, records-retention, or backup service. You remain responsible for keeping copies of material or outputs that matter to you.

To the maximum extent permitted by law, indirect, incidental, special, and consequential losses are excluded. To the maximum extent permitted by law, aggregate liability arising out of or related to the service is limited to the amount you paid for the affected service during the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory law.

11. Governing law, complaints, and changes

These Terms are governed by Estonian law, without prejudice to any mandatory consumer protections that apply in your country of habitual residence where such protections cannot lawfully be waived.

For non-consumer disputes, exclusive jurisdiction lies with the courts of Harju County, Estonia, unless mandatory law requires another forum.

Complaints and legal notices should first be sent to support@aisimilate.app.

If a consumer complaint cannot be resolved directly, Aisimilate will provide any legally required information about a relevant ADR route or whether it will participate in a qualifying ADR procedure, on a durable medium where required by applicable law.

The former EU Online Dispute Resolution platform was discontinued on July 20, 2025 by Regulation (EU) 2024/3228. Aisimilate does not rely on that discontinued platform, but consumers may still use any dispute resolution route available under mandatory law.

We may update these Terms when the service, legal environment, pricing structure, or risk controls change. Material updates will be reflected on this page with a revised date.

We may assign or transfer these Terms in connection with a merger, financing, reorganization, sale of assets, or group restructuring. You may not assign these Terms without our prior written consent, except where mandatory law provides otherwise.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect to the maximum extent permitted by law.
